Planning Proposal

The planning proposal is seeking to amend Bayside Local Environmental Plan 2021 in relation to land at 152 Bunnerong Road, Eastgardens.

What is being proposed?

The proposal is intended to facilitate the redevelopment of the existing Westfield Eastgardens.

The proposal would enable the expansion of retail, food, entertainment and leisure uses at the site, including a new publicly accessible plaza fronting Bunnerong Road with upgrades to the bus interchange.

The changes will also facilitate three commercial buildings including modifications to an existing 4 storey commercial building, a new 9-10 storey commercial tower above the retail podium and a new 8-10 storey commercial tower at the south-eastern corner of the site.

Key changes include:

  • increasing the maximum allowable floor space ratio (FSR) from 1:1 to 1.8:1
  • increasing the allowable building height to Part 34m, Part 40m, Part 59m on parts of the site with the remainder of the site unchanged at 25m
  • introducing a new clause for consideration in the assessment of future development applications to ensure that there is no increased risk to the community from surrounding hazardous industry and transport
  • adding the site to the Design Excellence Map so that Clause 6.10 Design Excellence of the LEP applies to the site

Background

Council’s at its meeting of 8 April 2020, deferred its decision subject to an independent review of the work to be done. In response to Council’s resolution, the proponent sought a Rezoning Review through the DPE as Council did not indicate its support 90 days after the submission of a Planning proposal. The Rezoning Review was facilitated by the Sydney Eastern City Planning Panel, who determined that the Planning Proposal had merit and should proceed to the next stage of the plan making process, being the issuing of a Gateway Determination.

A Gateway Determination was issued on 4 October 2023, enabling the Planning Proposal to proceed to public exhibition.

Additional Information

A draft Planning Agreement has also been submitted in connection with the Planning Proposal. This is being considered by Council under a separate process.
