What is being proposed?

This proposal aims to amend the Bayside Local Environmental Plan 2021 (Bayside LEP 2021) to allow advertising on bus shelters as exempt development across the Bayside Local Government Area (LGA), subject to certain size and location requirements.

A Gateway Determination was issued on 30 August 2024, enabling the Planning Proposal to proceed to public exhibition.

Current Rules

Signage is not a permissible use in every zone under the Bayside LEP 2021. At the moment, advertising on bus shelters is only allowed in specific areas—zones like local and commercial centres, productivity support, general industrial, mixed-use and public recreation and requires a development application approval.

What Will Change?

The Planning Proposal includes exempt development provisions for advertising on bus shelters under Schedule 2 Exempt development of the Bayside LEP 2021. The proposal will simplify the planning approval pathway to advertise on bus shelters by including clear rules in the Bayside LEP 2021 about what’s allowed. These provisions will control the size, level of illumination and location of the advertising to make sure there are no adverse impacts on the amenity of heritage sites or heritage conservation areas.
