Contributions to this consultation were evaluated and reviewed by Council and the Department of Planning, Housing and Infrastructure (DPHI).
Following DPHI’s finalisation assessment of the exhibited map amendment to the Bayside Local Environmental Plan 2021 (LEP), the Minister for Planning and Public Spaces made the LEP amendment.
The LEP map amendment was published on the NSW Legislation website on 21 June 2024, and became effective from that date.
A draft Planning Agreement has also been submitted in connection with the Planning Proposal. This is being considered by Council under a separate process.

Council is seeking submissions on a Planning Proposal for 88-96 New Illawarra Road and 307-311A Bexley Road, Bexley North.
What is being proposed?
This Planning Proposal is seeking to amend the Bayside LEP 2021 which applies to land at 88-96 New Illawarra Road and 307-311A Bexley Road, Bexley North by:
- Rezoning land from R2 Low Density Residential to R4 High Density Residential;
- Removing the 450m2 minimum lot size;
- Increasing the maximum height of buildings from 8.5m (2 storeys) to 20.5m (6 storeys); and
- Increasing the maximum floor space ratio from 0.5:1 to 2:1

Additional information
A draft Planning Agreement has also been submitted in connection with the Planning Proposal. This is being considered by Council under a separate process.
Council considered this proposal at its meeting of 12 June 2019, wherein it resolved not to support the progression of this Planning Proposal.
However, in response to Council’s decision, the proponent sought a Rezoning Review through the Department of Planning and Environment (DPE). The Rezoning Review was facilitated by the Sydney Eastern Sydney Planning Panel, who determined that the Planning Proposal had merit and should proceed to the next stage of the plan making process, being the issuing of a Gateway Determination. A Gateway Determination was issued on 3 May 2022, enabling the Planning Proposal to proceed to public exhibition.
The Planning Proposal will be on public exhibition from 24 October 2022 to 28 November 2022.
