Background
Recent changes to the Environmental Planning and Assessment Regulation 2021 require all NSW councils to prepare and adopt a policy that outlines how potential conflicts of interest will be managed for proposed council-related development. The Department of Planning and Environment (DPE) published Guidelines to assist councils in meeting these legal requirements by providing a sample policy and management strategy statement that can be used as a template.
The Draft Managing Conflicts of Interest for Council-related Development Applications Policy has been prepared in accordance with the DPE guidelines.
Summary of policy
The purpose of this policy is to manage potential conflicts of interest when Council is both a proponent and/or land owner for a proposed development, and the consent authority potentially granting approval for the development. The objective is to increase transparency at all stages of the development process for council-related development applications.
Council resolution
On 25 October 2023 Council considered a report on “Managing Conflicts of Interest for Council-related Development Applications - Draft Policy” (Item 10.7) and resolved the following:
1. That Council endorse the Draft Managing Conflicts of Interest for Council-related Development Applications Policy for public exhibition.
2. That a further report be prepared for Council following public exhibition of the Draft Managing Conflicts of Interest for Council-related Development Applications Policy.
