Council is seeking feedback from the community on the Draft Bayside Council Planning Agreement Policy.


Project background

In February 2021, the Department of Planning and Environment issued a Practice Note that encourages Councils to publish policies and procedures about their use of Planning Agreements. In response to the guidance provided in the Practice Note Council has developed a draft Council Planning Agreement Policy.

What is a Planning Agreement?

A Planning Agreement is a legal agreement entered into by a planning authority (such as Bayside Council) and a developer. Under the Planning Agreement, a developer agrees to provide contributions that link to improvements in local community services and facilities.


When is a Planning Agreement used?

Planning Agreements have the potential to be used in a wide variety of circumstances to achieve many different outcomes. Some examples of the potential application of Planning Agreements are:

  • Compensation for inconvenience or impacts caused by development
  • Meeting demand created by development
  • Prescribing inclusions in development
  • Providing benefits to the wider community as a host for development
  • Recurrent funding
  • Biodiversity offsetting

The draft Policy will be on public exhibition from 20 December 2022 to 7 February 2023.

The closing date for responses is Tuesday 7 February 2023.
